Replica vs homage comes down to the brand's trademarks. A replica copies the brand name, the logo and the design of a genuine watch. A homage takes a famous design but carries its own name and none of the brand's marks. The counterfeit rules in the United States, the European Union and Canada define counterfeit goods by the mark, so this difference matters more than quality or price.

How the official texts define a counterfeit
- United States. 19 CFR 133.21 defines a counterfeit mark as "a spurious mark that is identical with, or substantially indistinguishable from, a mark registered on the Principal Register of the U.S. Patent and Trademark Office", and lets US Customs and Border Protection detain and seize imported articles with such marks. The criminal law, 18 U.S.C. 2320, adds further conditions to its own definition, such as use in connection with trafficking.
- European Union. Regulation (EU) No 608/2013 defines counterfeit goods as "goods which are the subject of an act infringing a trade mark in the Member State where they are found and bear without authorisation a sign which is identical to the trade mark validly registered in respect of the same type of goods, or which cannot be distinguished in its essential aspects from such a trade mark".
- Canada. Section 51.03 of the Trademarks Act bans the import and export of goods when the goods or their labels or packaging bear, without the owner's consent, a trademark "that is identical to, or that cannot be distinguished in its essential aspects from, that registered trademark". Its exceptions include goods that an individual carries for personal use.
Quality is a separate question
